ARTICLE 1 - DEFINITIONS
1.1. Agreement: the agreement between the Customer and the Event Organiser for the purchase of Event Products and/or Services. This Agreement consists of these Conditions, the purchase confirmation and any other provisions attached to or referred to in these Conditions.
1.2. Cashless System: the online account that the Customer may create via its CHAOS account with the relevant provider for the purchase of an amount to the CHAOS Wristband.
1.3. Conditions: the present general terms and conditions, including any annexes.
1.4. Consumer: the natural person not acting in the course of his or her commercial, business, craft or professional activity.
1.5. Customer, You, Buyer: means the consumer, legal entity or de facto association that enters into the Agreement for the purchase of the Event Products and/or Services as provided herein.
1.6. Event: the Event/headline show organised by ‘CHAOS’.
1.7. Event Organiser: CHAOS BV, with registered office at 2000 Antwerp, Verschansingstraat 46 and company number BE0813.235.627, the organiser and producer of the Event.
1.8. Event Products and/or Services: means the products and/or services relating to the Event, as offered to and purchased by the Customer through the Official Ticket Distributor.
1.9. Event Site: the site at which the event takes place
1.10. Event Visitors: You, Customer, Buyer and all Event ticket holders and/or Wristband holders and/or special access voucher holders, that want to enter the Event Site or have entered the Event Site.
1.11. Force Majeure: Any of the following circumstances which render the performance of obligations (other than payment obligations) under the Agreement and/or the Event impossible, impracticable or unsafe. These circumstances include: natural disaster, unavoidable accident, fire, strike or other industrial action, war or threat of war, act of hostility towards the state, act of terrorism or threat thereof, riot or civil commotion, national emergency, promulgation, rule, order or act of any government or instrument of government, failure of technical facilities, epidemic (including a health epidemic), pandemic (including a health pandemic), interruption or significant delay or failure of technical facilities, or failure or significant delay of necessary transport services, or any other event or circumstance beyond the reasonable control of the Event Organiser, as applicable. Adverse weather conditions shall in principle not be considered a Force Majeure event, provided, however, that if such weather conditions are severe or threatening enough for a declaration by applicable governmental authorities that the conditions threaten public safety, such weather conditions shall be considered a Force Majeure event hereunder.
1.12. Official Exchange Desk: this is the only official manner in which Event tickets can be exchanged. The Official Exchange Desk – if available – will be published on the Official Website. In any case, the Event Organiser is not obliged to provide an official exchange desk.
1.13. Official Ticket Distributor: WEEZTIX BV
1.14. Official Website: www.chaosinthecity.events
1.15. Wristband: this means the wristband you receive when you exchange your official and valid event ticket and/or special access voucher at the Event entrance on the Event Site.
All definitions in this Article and these Conditions have the same meaning regardless of whether they are used in plural or singular.
ARTICLE 2 – THESE CONDITIONS
The Conditions form an integral part of the Agreement that is concluded as a result of the purchase of one or more Event tickets and/or entering the Event Site. The Buyer is requested to accept these general terms and conditions during the purchase process. You can always consult the Conditions at www.chaosinthecity.events or on request via info@chaosinthecity.events.
You, the Customer, Buyer and all Event Visitors are bound by these Conditions.
ARTICLE 3 – TICKET PURCHASE
3.1. The Event tickets are in the name of the Buyer. Tickets don’t have to be purchased in your name. You can buy tickets for yourself and your friends. The tickets need to be personalized before or after they have been purchased. Without prejudice to the application of article 4, when purchasing a ticket for a third party, this third party shall be considered to have accepted these Conditions, which the Buyer guarantees.
3.2. Tickets can only be purchased through the Official Website or the website of the Official Ticket Distributor. Tickets purchased in any other way (i.e. via another channel or via avoidance, in any way whatsoever, of the official procedure providing access to the ticket shop) can be cancelled at the expense of the Buyer. It is therefore strongly advised to never purchase an Event ticket via another channel than the Official Website or the Official Ticket Distributor.
3.3. The Event Organiser reserves the right to prosecute any holder of a forged ticket or Wristband and any person who fails to comply with these Conditions. Forgery of the Event ticket or Wristband will be subject to legal prosecution. Regarding this provision, the Event Organiser and/or the Official Ticket Distributor reserve the right to verify the identity of the Event visitor through his/her identification document (cfr. art. 8).
3.4. Changes in the line-up will not result in a refund of the ticket for the Event, not even partly.
3.5. If you have lost your Event ticket, didn’t receive it or have any other problem, please contact the Official Ticket Distributor. Visit their website for more information.
You can buy your Event tickets online or at the entrance of the Event Site as long as the Event is not sold out. Buying Event tickets means you agree to our Conditions.
3.6. Printing your Event ticket is not necessary. Show it on your mobile phone at the entrance of the Event Site.
ARTICLE 4 – RESELL OR EXCHANGE OF TICKETS
It is, in principle, not permitted to resell or exchange Event tickets or Wristbands. It is only permitted to exchange tickets via the Official Exchange Desk of the Event Organiser (if available). The Event Organiser and/or the Official Ticket Distributor also reserve(s) the right to cancel Event tickets in case it is established that these tickets are offered for sale or were fraudulently purchased despite this being prohibited. The costs resulting from the cancellation shall be borne by the seller and the purchaser, respectively.
ARTICLE 5 –COMMERCIAL/PROMOTIONAL PURPOSES/ITEMS
5.1. Event tickets or Wristbands cannot be used for commercial or promotional purposes without the permission of the Event Organiser, nor may the name of the Event be used for such purposes. In the event of such an action or use of the Event name for commercial purposes, both the Buyer of the respective tickets and the organiser of the prohibited action will have to pay compensation amounting to at least EUR 15,000.00. The latter amount does not prejudice the right of the Event Organiser to seek compensation for the actual damages suffered and/or the immediate suspension of the prohibited actions.
5.2. It is forbidden to distribute flyers or any other promotional items or to put up posters during the Event or in the vicinity of the Event Site. If you wish to promote another event, please consult with the Event Organiser in advance in order to obtain its written permission to do so.
5.3. The official sale of T-shirts, merchandising, other clothing and/or souvenirs related to the Event is only permitted within the Event Site with explicit prior written permission of the Event Organiser.
5.4. Images made by Event Visitors on the Event Site, cannot be used for commercial or public purposes without the prior written consent of the Event Organiser.
ARTICLE 6 - WRISTBANDS
All Event Wristbands will be submitted on the Event Site in return for a valid and official entry ticket or valid and official purchased ticket at the box office. Exchanging or upgrading a ticket type is not possible after having completed the personalisation process.
ARTICLE 7 – ACCESS AND ACCESSIBILITY TO THE EVENT
7.1. Each person moving towards the entrance of the Event/Event Site must hold a valid Event Wristband registered in the name of the purchaser or a special access voucher granted by the Event Organiser. One Event Wristband is only valid for access of one single person on the day or days for which the ticket was purchased or as detailed on the special access voucher.
Each person holding a valid Event ticket or valid special access voucher must have validated his/her personal Wristband or access voucher in order to have access to the Event Site.
7.2. To access the Event Site, you must be at least 18, this means you have to be 18 on the day that you want to access the Event Site. If you are 16 or 17 on the day that you want to access the Event Site, you are welcome under the supervision of an adult who is at least 30 years old.
Any questions or requests regarding entry for those under 16 can be sent to info@chaosinthecity.events.
Our Event Site is not designed for children, so we strongly suggest against attending with them. Attending the Event Site with children, even after you received permission by the Event Organiser, will be at your own risk and responsibility at all times.
7.3. We maintain an IN = IN, OUT = OUT policy. It is not allowed to leave and re-enter the Event Site on the same day by using your Event Wristband. Exceptional re-entry for day ticket holders is only possible after approval from the Event Organiser.
7.4. The Event Organiser makes extra efforts to make the Event accessible to Event Visitors with disabilities, to the extent that the terrain of the Event Site and its surroundings permit. If you have a specific need or question regarding the accessibility of the Event Site, the Event Organiser will endeavour to take this request into account if you notify the Event Organiser in writing, at least 14 days prior to the Event.
ARTICLE 8 – VERIFICATION OF YOUR IDENTITY
The Event Organiser and/or the Official Ticket Distributor retain(s) the right to verify the identity of the Event Visitor when entering the Event. You must therefore be in possession of a valid identification document. In case of non-compliance, you may be denied access to the Event without the right to replacement of the ticket, refund of the purchase price of the ticket or any other form of compensation.
A valid identification document (i.e. proof of identity) is only understood to mean: a valid identity card, a valid passport or a valid driving license. Copies will not be accepted.
ARTICLE 9 – SAFETY MEASURES WHEN ENTERING THE EVENT
9.1. Entering the Event implies acceptance of all prevention and control measures taken by the Event Organiser or its security team, including the search of a person and its bags/belongings. Anyone wishing to enter the Event may be searched by authorized security personnel before gaining access to the Event, in accordance with applicable laws and regulations.
9.2. Security has the right to ask the Event Visitors of the same gender to scan and/or search clothes and bags/belongings for the purpose of intercepting prohibited objects (cfr. art. 11). Upon finding such objects, security has the right to confiscate them. If You, as an Event Visitor, refuse the search and/or scan by the security personnel, You may be denied access to the Event without the right to replacement of the ticket, refund of the purchase price of the ticket or any other form of compensation.
ARTICLE 10 – PROHIBITION OF ACCESS TO THE EVENT
Access to the Event is also forbidden and/or can be denied to the Event Visitor if:
10.1. You are under the influence of alcohol and/or drugs;
10.2. You are in the possession of drugs or dealing drugs;
10.3. You are in the possession of prohibited objects (cfr. art. 11);
10.4. You refuse to be searched by authorized security personnel;
10.5. You refuse to comply with these Conditions;
10.6. You have already been denied access in the past to other events organized by the Event Organiser or associated companies;
10.7. You show clear behaviour with the intent of disrupting public peace or provoking by inciting violence, hatred, aggression etc.;
In all of the above cases, there will be no right to replacement of the Event ticket, refund of the purchase price of the ticket or any other form of compensation.
ARTICLE 11 - PROHIBITED OBJECTS
Following objects are prohibited on the Event Site:
11.1. cosmetic products (sun cream, perfume, etc.) in packaging with a volume of more than 100 ml;
11.2. aerosols (deodorants, etc.), irrespective of the package size;
11.3. own beverages or food;
11.4. drugs or other illegal mind-altering substances;
11.5. pyro-technical objects (Bengal fire, fireworks, torches, etc.);
11.6. clothing, banners and/or other items with discriminatory and/or provocative texts and/or expressions which can be used as means to disturb the public peace, endanger the safety of the crowd and/or damage/hurt people and/or goods;
11.7. glass items;
11.8. any other item (including but not limited to: weapons, sharp pointed objects, drones, animals, umbrella, sunscreen, tripod for camera (film), laser pens, etc.) that is considered dangerous by the security staff for other Event visitors;
11.9. It is forbidden to enter the Event Site with a vehicle without permission (provided by the Event Organiser). In case of violation of this provision, your car/vehicle will be towed away at your own expense.
ARTICLE 12 – PERMITTED OBJECTS
As an exception to the list of prohibited objects, as mentioned in Article 11 of these Conditions, the following objects shall be permitted:
12.1. cosmetic products (sun cream, perfume, etc.) in packaging (no aerosols) with a maximum volume of 100 ml;
12.2. deodorant in roll-on sticks;
12.3. refreshing water in spray;
12.4. disposable single-use or pocket photo cameras;
12.5. retractable umbrellas without top pin (no parasols);
12.6. plastic(items);
12.7. blankets to sit/lie on;
12.8. small rucksacks and other bags;
12.9. selfie-sticks are permitted if their length in extended position does not exceed 1 meter and if they have been exclusively designed for photography purposes;
12.10. Medication that You need to take due to health reasons, accompanied with necessary doctor’s statement or medical package leaflet;
12.11. (reading)glasses and sunglasses.
ARTICLE 13 – RULES AND REGULATIONS ON THE EVENT SITE
At the Event Site, it is strictly prohibited to:
13.1. enter areas You don’t have access to on the basis of the ticket you have purchased (backstage area, press area etc.);
13.2. climb on tents, constructions, gates, light bridges, seating areas or any other constructions on the Event Site;
13.3. block entrances, exits and emergency exits;
13.4. disguise for the purpose of not being recognizable and disrupting the public peace and/or endangering the safety of others;
13.5. sell food, beverages or any other product without the explicit permission of the Event Organiser;
13.6. throw or shoot with objects in solid, fluid or gas form;
13.7. make fires;
13.8. any action with the intention to fight, discriminate, (sexually) harass or other inappropriate behaviour;
13.9. any action which can cause any danger or hindrance to the Event Visitors.
Failing to comply with the above prohibitions may result in immediate removal from the Event Site and further access to the Event may be denied to you without the right to replacement of the ticket, refund of the purchase price of the ticket or any other form of compensation.
ARTICLE 14 – ZERO-TOLERANCE ON DRUGS
There is an absolute zero-tolerance policy on drugs. It is forbidden to use, deal and/or possess drugs at the Event. If found in any of the cases above, you will be removed from the Event Site and further access to the Event Site will be denied without the right to replacement of the ticket, refund of the purchase price of the ticket or any other form of compensation.
This policy is strictly enforced and, in any event, means that the matter will be referred to the police in all cases. This will be strictly monitored.
ARTICLE 15 – NO CROWD SURFING
Crowd surfing is explicitly forbidden. Non-compliance with this measure will inevitably result in removal from the Event Site and further access to the Event Site will be denied without the right to replacement of the ticket, refund of the purchase price of the ticket or any other form of compensation.
ARTICLE 16 – OBLIGATION TO COMPLY WITH INSTRUCTIONS
Event Visitors must always comply with the instructions provided by the Event Organiser or the designated/authorized person on the Event Site. The Event Visitor agrees to comply with the instructions given by the Event Organiser for the purposes of ensuring public peace and safety during the Event. Non-compliance with these instructions may result in removal from the Event Site and further access to the Event may be denied without the right to replacement of the ticket, refund of the purchase price of the ticket or any other form of compensation.
ARTICLE 17 – KEEPING THE EVENT SITE CLEAN
17.1. We ask all Event Visitors to contribute to keeping the Event Site as clean as possible. The Event Site offers a sufficient number of areas where you can dispose of your waste. You are requested to use these facilities.
17.2. The use of toilets and refreshment points is free at the Event Site. It is strictly forbidden to urinate in public. Urinating in public may result in removal from the Event Site and further access may be denied to you without the right to replacement of the ticket, refund of the purchase price of the ticket or any other form of compensation.
17.3 The Event takes specific measures to be sustainable and ecological therefore it is not allowed for Event Visitors to smoke in places where smoking is prohibited. Event Visitors are not allowed to dispose cigarettes or vapes on the ground of the Event Site. Cigarettes or vapes need to be disposed in the specific waste bins for cigarettes / vapes or pocket ashtrays.
ARTICLE 18 – USE OF ATTRACTIONS
18.1. Attractions may be made available to the Event Visitors on the Event Site.
Event Visitors can only make use of these attractions if the Event Visitors (a) are in good health and do not have any physical complaints that may affect their stress and heights tolerance, (b) are not under the influence of alcohol, drugs, medicines and/or other related substances and (c) have no fear of heights.
Event Visitors must at all times sit still in their designated seat for the duration of the attraction (ride) while being constantly secured by the provided protection. It is forbidden to throw objects out of the attraction, to smoke, to eat and drink for the duration of the attraction (ride).
18.2. In case of non-compliance of the rules, abuse, deception and/or fraud, the Event Organiser reserves the right to exclude the Event Visitor from the attraction during the further course of the Event.
18.3. Using any attraction provided by the Event Organiser shall be the full responsibility of the Event Visitor, the limitation of liability as provided in articles 21 and 22 applies in any case.
ARTICLE 19 - CASHLESS SYSTEM
19.1. By accepting these Conditions, the Customer and Event Visitor accept the used cashless system for money transactions on the Event Site. This system implies that you load credits to your Event Wristband via bank transfer at the designated ‘stations’ provided at the Event Site or directly via bank transfer on your mobile phone.
19.2. The Event Organiser cannot be held liable if the cashless system does not operate, does not operate without defects or operates only partially during the Event. In such a case, the Event Organiser shall endeavour to resolve the issue as soon as possible and the Event Organiser shall provide a back-up scenario for Event Visitors, for example by providing payment tokens.
19.3. All disputes relating to the Cashless System transactions must be reported immediately to the helpdesk or to info@chaosinthecity.events. Event Visitors are requested to attach the necessary supporting documentation when communicating with the Event Organiser.
19.4. The Event Organiser cannot be held liable for theft or loss of the Event Wristband.
ARTICLE 20 – REFUND AFTER THE EVENT
20.1. Credit balances that are still on your Event Wristband after the end of the Event can be recovered via the designated refund system that is available on the Official Website, taking into account the conditions set out in this article.
20.2. The refund can be requested as of the first day after the Event, via the designated refund link on the Official Website. This link will remain available for a period of twenty (20) days. After 20 days, no refunds shall be possible under any circumstance. The credit shall be refunded as soon as possible following the closure of the aforementioned link on the Official Website.
20.3. In the following cases there will be no refund of the credit after the end of the Event:
- if the balance on the Wristband of the Event Visitor is less than €1.50 (one and a half euros);
- in case the Event Visitor received free credits and did not use them. The Event Organiser hereby expressly clarifies that it always uses the paid credits first, and the free credits last (i.e. after the paid credits). The remaining free credits will in no case be refunded to the Event Visitor;
- in case the credit on the Wristband is part of a VIP formula;
- credits that are related to the cup, can or PET bottle of the Event Visitor.
20.4. The Event Organiser’s cashless payment system is offered to the Event Visitor with support of the following third-party service provider: PlayPass NV.
ARTICLE 21 – FIRST AID AND MEDICAL CARE
21.1. There are one or more first aid posts (EHBO-post) on the Event Site, where qualified personnel can provide basic medical assistance. Event Visitors can turn to these posts at any time for first aid or medical support.
21.2. The medical care provided is limited to first aid and is not intended to replace professional medical treatment. If, in the opinion of the first aid staff or the Event Organiser, additional (professional) care is necessary, the visitor may be referred to external medical services or, in emergency situations, the emergency services may be contacted.
21.3. Event Visitors remain responsible for their own health at all times and for following the instructions of the first aid and security staff. Participation to the Event and use of the first aid facilities provided, is at the risk of the Event Visitor.
21.4. The Event Organiser is not liable for damage or injury resulting from:
- the availability or unavailability of first aid staff at any given time; they might be occupied with other Event Visitors;
- Following or not following medical advice;
- The state of health of the Event Visitor prior to or during the Event;
- Actions taken by external medical emergency services.
ARTICLE 22 – LIABILITY WAIVER
22.1. The Event Organiser shall only be liable for damages directly and exclusively resulting from an error by the Event Organiser. Excluded from compensation are (i) damages and losses caused by Force Majeure, (ii) consequential damages and (iii) damages caused by misconduct, recklessness or serious fault by the damaged party.
22.2. The Event Organiser is not liable for damages, theft or any accidents to vehicles or persons in parking accommodations (such as parking lots, street parking, public parking spaces, etc.) in the vicinity of the Event Site. Such parking lots are always used at your own risk.
22.3. The Event Organiser may only cancel or postpone the Event in case of Force Majeure or if the Event Organiser has another demonstrable compelling reason to cancel or postpone the Event. You shall in such case be entitled to compensation in respect of the purchased Event Products and/or Services in accordance with applicable law but shall not be entitled to any compensation for any (other) damages (direct or indirect).
22.4. The Event Organiser may be forced to alter, adjust or cancel (parts of) the Event programme due to weather conditions or other Force Majeure events. This will not result in a refund of the purchase price of the Event ticket, not even partly.
22.5. The Event Organiser may be forced, due to security reasons, to temporarily keep Event Visitors on the Event Site, oblige Event Visitors to (temporarily) leave the Event Site or deny Event Visitors (temporarily) access to the Event Site. This will not, in any case, result in a partial or full refund of the purchase price of the Event ticket.
22.6. Notwithstanding article 6.3, §1 of the Belgian Civil Code, the Event Organiser cannot be held extra-contractually liable by the Event Visitor, except in the event of intentional misconduct or infringement of the physical or psychological integrity of the injured party.
Notwithstanding article 6.3, §2 of the Belgian Civil Code, the Event Visitor or any other injured party in the contractual chain cannot invoke the statutory provisions regarding extra-contractual liability with respect to the Event Organiser’s auxiliary Persons, except in the event of intentional misconduct or infringement of the physical or psychological integrity of the injured party.
The auxiliary persons include any natural person or legal entity entrusted by the Event Organiser with the full or partial performance of a contractual obligation entered into by the Event Organiser, throughout the entire contractual chain, including but not limited to subcontractors, employees, directors, etc. The auxiliary persons may rely on the provisions of this article 22.
ARTICLE 23 – LOSS OR THEFT
23.1. The Event Organiser cannot be held responsible for any damages (including, but not limited to, physical damage), loss or theft, nor for any accident whatsoever.
23.2. In case of loss, theft or damage of the entry ticket, the Event Wristband or the special access voucher, there will be no right to replacement of the ticket, refund of the purchase price of the ticket or any other form of compensation. The same applies to the RFID chip on your Event Wristband, which could contain a cash balance.
ARTICLE 24 - PRIVACY AND PERSONAL DATA
24.1. Within the framework of its activities, the Event Organiser processes the personal data of Customers and Event Visitors. By entering into a contract with the Event Organiser (through the purchase of the Event ticket) and by visiting the Event, the Event Visitor agrees to the use of such personal data. Personal data will be processed by the Event Organiser in accordance with its Privacy Policy, which will be communicated when ordering an Event ticket. This Privacy Policy is also available at all times on the Official Website and can also be requested from the Event Organiser at info@chaosinthecity.events.
24.2. Event Visitors may be photographed and/or filmed during the Event on the Event Site. The Event Visitors waive their portrait rights as soon as they enter the Event Site. This means that images with the portrait of the Event Visitors can be used for promotional and commercial purposes and/or for security reasons. The above also applies to audio recordings.
24.3. Images made by Event Visitors on the Event Site, on the other hand, cannot be used for commercial or public purposes without the prior written consent of the Event Organiser.
ARTICLE 25 – DISPUTES, APPLICABLE LAW AND JURISDICTION
25.1. Any disputes must be notified to the Event Organiser by registered letter within 8 (eight) days after the arising of any complaint at the registered office of the Event Organiser.
25.2. These Conditions (and any disputes arising thereof) are exclusively governed by Belgian law. All disputes shall be settled by the competent courts and tribunals of the judicial district where the Event takes place, to the exclusion of all other courts.
ARTICLE 26 - INVALIDITY OF A PROVISION OF THESE CONDITIONS
If any provision of these Conditions, or any part thereof, is or is declared invalid or unenforceable, the remaining provisions of these Conditions or the remainder of that provision shall remain in full force and effect and such provision shall be automatically replaced (by operation of law) by a valid provision that is as close as possible to the invalid provision.
